Welcome to GiggleTime. These Terms of Service ("Terms", also referred to in our apps as our "Terms of Use") govern your access to and use of the GiggleTime website, mobile applications, and related services (collectively, the "Service"), operated by Whiz Art Media Ltd (registered in Bulgaria as Уиз Арт Медиа ЕООД, EIK 206971482), registered address m-t Peshterna Reka, 754V, Sliven, Bulgaria ("GiggleTime," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account. By using the Service, you confirm that you meet this requirement. If you are located in a jurisdiction with a higher age of digital consent, the higher age applies.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when registering and to keep it up to date. You may delete your account at any time from within the app, in accordance with our Privacy Policy.

3. User-Submitted Content

Ownership. You retain ownership of any joke, comment or other content you submit to GiggleTime ("User Content"). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, translate, adapt, and distribute that content on and through the Service, including generating AI translations and audio versions of it.

Your responsibility. You confirm that you have the right to submit the content you post, and that it does not infringe on anyone else's copyright, trademark, or other rights. Submitting content you did not write and do not have the right to share (e.g. copyrighted material, another comedian's original material without permission) is prohibited.

Attribution. Where you provide an author name or attribution when submitting a joke, we will display it as provided. We do not independently verify the accuracy of attribution claims and are not responsible for attribution disputes between users.

Comedian Profiles. GiggleTime maintains a directory of comedian profiles for attribution purposes. Information displayed on these profiles is limited to publicly available information (such as a comedian's name, nationality, publicly stated biography, and links to their own public social media or official websites). We do not use private, non-public, or improperly obtained information to populate comedian profiles.

Claiming a Profile. A comedian (or their authorized representative) may request to claim their profile in order to verify, edit, or manage the information displayed. We reserve the right to require reasonable proof of identity or authorization before granting a claim request. Content added to a claimed profile is User Content and is subject to these Terms, including Section 5.

Disputes and Removal. If you are a comedian (or represent one) and believe a profile, attributed joke, or any associated content is inaccurate, was not sourced from public information, or should not appear on GiggleTime, please contact us at [email protected]. We will review such requests and remove or correct content we determine to be inappropriate, inaccurate, or improperly sourced.

Moderation and reporting. How we moderate User Content, and how you can report content or block other users, is described in Section 5.

4. Comedian Directory

GiggleTime's comedian directory is provided for informational and attribution purposes only. Inclusion in the directory does not imply endorsement of GiggleTime by the comedian, nor any formal relationship between GiggleTime and the comedian, unless the comedian has explicitly claimed and taken ownership of their profile.

We do not guarantee the accuracy or completeness of comedian profile information, particularly for unclaimed profiles, which are populated based on publicly available sources. Users should not rely on directory information as verified or authoritative until a profile has been claimed and confirmed by the comedian themselves.

5. User Content and Conduct

Zero tolerance. There is zero tolerance for objectionable content or abusive users. You must not post content that is hateful, harassing, sexually explicit, violent, defamatory or illegal.

You also agree not to:

• Submit content that sexualizes or otherwise endangers minors
• Submit content that infringes others' intellectual property rights
• Harass, threaten, bully or impersonate another person or entity
• Post spam, advertising, or repetitive or misleading content
• Attempt to manipulate voting, ratings, reporting or moderation systems
• Use automated means (bots, scrapers) to access or extract content from the Service without our permission
• Attempt to circumvent usage limits, paywalls, or security measures

Reporting and blocking. Any user can report content or block other users. Every joke, comment and claimed profile has a "Report" option; reported content is hidden from the person who reported it straight away. Blocking a user hides all of their jokes, comments and profile content from you, and you can unblock users at any time from My Account. You can also report content by email to [email protected].

Moderation. We review all reports within 24 hours and will remove offending content and suspend or ban users who break these rules. A banned account can no longer log in or post, and its content is hidden from the Service. We may also review, edit or remove any User Content on our own initiative.

6. Subscriptions and Payments

Premium features are available via paid subscription, billed monthly or annually depending on your selection. Subscriptions purchased via our website are processed by Stripe; subscriptions purchased via our iOS or Android apps are billed by Apple or Google respectively and subject to their own terms. See our Refund and Cancellation Policy for details on refunds and cancellation.

We may change subscription pricing from time to time. If we do, we will provide notice before the change takes effect for existing subscribers, and continued use of Premium after that point constitutes acceptance of the new price.

7. Free Tier Limits

Free accounts are subject to daily usage limits on certain features (such as AI translation and premium text-to-speech), as described within the Service. These limits may change at our discretion.

8. Intellectual Property

The GiggleTime name, logo, design, and underlying software are the property of Whiz Art Media Ltd and may not be copied, reproduced, or used without our permission. This does not apply to User Content, which remains owned by its submitter as described in Section 3.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated translations or audio will be perfectly accurate. Jokes and content on the platform reflect the views of their submitters, not necessarily our own.

10. Limitation of Liability

To the maximum extent permitted by law, Whiz Art Media Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Suspension and Termination

We may suspend or permanently ban your account if you violate these Terms, including the rules in Section 5. You may stop using the Service and delete your account at any time.

12. Changes to These Terms

We may update these Terms from time to time and will post the updated Terms with a new "Last updated" date. When we make material changes, we will ask you to review and accept the updated Terms before you continue using the Service. If you do not accept them, please stop using the Service; you can delete your account at any time.

13. Apple App Store

If you downloaded our iOS app from the Apple App Store, the following also applies:

• These Terms are between you and Whiz Art Media Ltd only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the app and its content.
• Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
• In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms (for example, your mobile data provider's terms) when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, have the right to enforce them against you as a third-party beneficiary.

14. Governing Law

These Terms are governed by the laws of Bulgaria, without regard to conflict of law principles. Any disputes shall be subject to the jurisdiction of the courts of Bulgaria, except where mandatory consumer protection law in your country of residence provides otherwise.
